• Real-time analytics and monitoring dashboards
• Decentralized governance and reputation systems

3. User Accounts

3.1 Registration

You must register for an account to use the Service. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Enable multi-factor authentication (MFA) for enhanced security
• Promptly update your account information when it changes
• Accept responsibility for all activities under your account

3.2 Eligibility

You must be at least 18 years old and legally capable of entering binding contracts. By using the Service, you represent and warrant that you meet these requirements.

5. Intellectual Property

The Service, including all content, features, and functionality, is owned by CreatorAI-Pro and protected by international copyright, trademark, and intellectual property laws.

5.2 User Content

You retain ownership of AI agents, data, and content you create. By using the Service, you grant us a limited license to host, store, and process your content to provide the Service.

5.3 NFT Ownership

NFT-tokenized AI agents are represented as blockchain assets. Ownership is determined by blockchain records. We do not guarantee the value or transferability of NFTs.

6. Fees and Payment

6.1 Subscription Plans

Our pricing tiers (Starter, Professional, Enterprise) are detailed on our website. Fees are subject to change with 30 days notice.

6.2 Billing

• Subscription fees are billed monthly or annually in advance
• Usage-based charges (API calls, compute resources) are billed monthly in arrears
• Blockchain transaction fees (gas) are your responsibility
• All fees are non-refundable except as required by law
• Payment is processed securely through Stripe

6.3 Taxes

Fees exclude applicable taxes (VAT, sales tax, GST). You are responsible for paying all taxes associated with your use of the Service.

7. Blockchain and Smart Contracts

7.1 Blockchain Transactions

Blockchain transactions are irreversible. You acknowledge and accept the risks associated with blockchain technology, including but not limited to:

• Network congestion and delayed confirmations
• Variable transaction fees (gas prices)
• Smart contract bugs or vulnerabilities
• Permanent loss of assets due to user error
• Regulatory uncertainty in blockchain jurisdictions

7.2 Decentralized Governance

AI agents may participate in decentralized governance mechanisms. Voting outcomes are binding and determined by smart contract logic, not by CreatorAI-Pro.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement or accuracy
• Guarantees of uninterrupted, secure, or error-free service
• Warranties regarding AI agent performance or outcomes
• Guarantees of blockchain transaction success or NFT value

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATORAI-PRO SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from blockchain transactions or smart contract failures
• Damages exceeding the fees paid by you in the 12 months prior to the claim
• Damages caused by third-party services (AI providers, cloud platforms)

10. Indemnification

You agree to indemnify, defend, and hold harmless CreatorAI-Pro from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your infringement of any intellectual property or other rights
• Your AI agents' actions or outputs
• Your blockchain transactions or smart contract interactions

11. Termination

11.1 By You

You may terminate your account at any time through account settings or by contacting support.

11.2 By Us

We may suspend or terminate your account immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay fees when due
• Engage in fraudulent or illegal activities
• Pose a security risk to the platform

11.3 Effect of Termination

Upon termination, your access to the Service will cease. We will retain data as required by law or our Privacy Policy. NFT assets on blockchain remain under your control via your wallet.

12. Governing Law and Disputes

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with JAMS rules.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or platform notification. Continued use after changes constitutes acceptance.

14. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and CreatorAI-Pro
• Severability: If any provision is unenforceable, the remaining provisions remain in effect
• Waiver: Failure to enforce a right does not constitute a waiver
• Assignment: You may not assign these Terms without our consent
• Force Majeure: We are not liable for delays due to circumstances beyond our control
